The White House announced last week that Broas “withdrew his nomination for personal reasons.”

But, reading between the lines, it’s pretty clear what happened.

Broas’ list of accomplishments is long: he won accolades for his work; serve on an esteemed think tank (Woodrow Wilson International Standard for Scholars); garnered praise from former presidential nominee John Kerry, who called me a “quintessential family man (who)…is a living example of the kind of compassion and strength that we expect from our nation’s diplomats.”

Yet his DUI got in his way.

Not every Los Angeles DUI arrest involves a $190,000 Bentley getting wrapped around a telephone pole and a superstar athlete. But last Saturday, Jon “Bones” Jones, 24-year old UFC fighting champ, did just that in Binghamton, New York. JJones-DUI.jpg

Jones was arrested by the Broome County Sheriff — the same agency for which he created a police training film a few months ago. An ironic twist of events, indeed. In the wake of the incident, the light heavyweight king – who bested Rashad Evans on April 21 in a unanimous decision – got called to the carpet by Dana White, the President of the UFC.

White told the Boston Herald, in blunt terms, how he felt about Jones’ situation: “[Jones] could… go down as the greatest ever – beat everybody, do all the stuff, be the first guy to break through and get a Nike deal… do you want to be that guy or do you want to go the other way?” White then proceeded to describe in graphic, expletive filled detail what precisely the “the other way” would entail.

Not good things.

If you’ve been arrested for driving under the influence of marijuana or alcohol in Burbank, you are probably wondering how you’ll be charged, whether you’ll go to jail, and what you can do, if anything, to battle back. Last week, Colorado lawmakers scuttled a bill that would have created a “BAC-like” level for marijuana DUI. Colorado house bill 12S-1005 was defeated by a razor thin margin; had it passed, then Colorado drivers who drove with a THC level of more than 5 nanograms per milliliter of blood could be charged and convicted of a serious crime. The District Attorney for Boulder County told lawmakers that 15% of the impaired driving cases he sees involve marijuana, and that the vast majority of these cases require a lot of work and time to manage.

The D.A. and others argued that there need to be some standards. Law enforcement officials – and drivers and citizens – need to know what’s allowed and what’s not allowed, so they can make safer decisions and more efficient law enforcement decisions.

Opponents of the measure argued that the 5 nanogram THC level is an unfair standard, for a variety of reasons:

• Some marijuana users have a higher tolerance to the drug than others – thus one could have a high THC level in the blood and still be perfectly sober and capable of driving;
• The chemical THC gets stored in the people’s fat cells, so there is a latency effect. You can be stone sober, but the residual marijuana in the fat cells could screw up your reading and lead to unfair convictions;
• There is no clear method by which marijuana users can test themselves to know whether they are sober enough to drive – like there is with (admittedly flawed) devices like Burbank DUI breathalyzer tests.

On April 6th, actress Amanda Bynes was arrested for driving under the influence in West Hollywood, after she banged into cop car while driving erratically. In retrospect, the warning signs were there. Back in March, Bynes got in trouble for fleeing a police officer, who had stopped her for chatting on her cell phone while behind the wheel. Late last Sunday night, the 26-year-old attempted a three-point turn outside of SUR Restaurant in West Hollywood. She wasn’t arrested… but she certainly seemed “out of it,” according to a witness who spoke with the celebrity gossip magazine, People. Said the witness, “[Bynes was] holding up traffic and doing an incredibly slow three-point turn in the middle of Robertson… she looked wobbly – I guess, it could have been the heels since she was wearing sky-high nude pumps, but she did seem out of it.”

Of course, it’s easy for celebrity gossip columnists to jump to the worst conclusions about celebrity behavior. That’s basically their job. If you or someone you care about was stopped at a check point or arrested after an accident for DUI, your world probably feels upside down right now. No one expects to get a DUI. No one plans for it. But then, all of a sudden, you are tagged with one, and your life gets launched in a new, unexpected, and unwanted direction. This preamble is an attempt to explain – or least put into context – a DUI-related suicide out of the University of Florida. 26-year-old Michael Edmonds, Jr., died the Sunday before last after jumping down the stairwell at the University of Florida’s Ben Hill Griffin Stadium. Edmonds had been arrested the day before on a DUI charge. The next day, a student heard a loud noise coming from the stadium and rushed in and found Edmond’s body on the sidewalk. She dialed the police while others arrived to assist, but Edmonds could not be revived. Obviously, the investigation is ongoing, and it would be premature and disrespectful to connect Edmond’s suicide with his DUI arrest.

Just weeks after his ex-wife, Whitney Houston, drowned on the eve of the Grammy’s, singer Bobby Brown got stopped and arrested for driving under the influence in Los Angeles. The R&B singer (and founder of New Edition) was charged with driving on a suspended license as well as two Los Angeles DUI counts, including allegations that he exceeded the legal limit of 0.08% BAC, as defined by California Vehicle Code Section 23152(b).bobby-brown-los-angeles-dui.jpg

The California Highway Patrol stopped Brown last Monday, when he was seen chatting on a cell phone. The CHP officer thought Brown looked intoxicated and forced the R&B legend to submit to a field sobriety test, which he apparently failed. Brown is due back in court on April 16. He faces up to half a year in jail if he’s convicted of all his charges. As any Los Angeles DUI attorney will tell you, Brown has a lot of work cut out for him if he wants to fight the charges and get his life back on track.

Unsurprisingly, the celebrity news buffs and commentators in the blogosphere have gone hog-wild discussing the psychological reasons why Brown might have driven DUI. But rather than delve into celebrity dirty laundry, let’s reflect a bit about what we can learn from Brown’s charges and how to apply those lessons in our own lives.

1. Emotional stress can lead us to make poor driving decisions.

Obviously, it’s impossible to tell what, if any, role Houston’s death played in Brown’s DUI. But it’s reasonable to assume that it did play some role. When we go through periods of stress, disorientation, overwhelm, or panic in our lives, we may find it easy to reach out to alcohol, narcotics, or prescription drugs to relieve the pain. According to California Highway Patrol reports, Brown was talking on the cell phone without a hands free headset – a big no-no, an illegal act, in and of itself. He had also been driving on a suspended license. So he was already on thin ice. And then he drove (allegedly) DUI. All these various problems no doubt will complicate his Los Angeles DUI defense.

Last November 14th, LA Dodgers first baseman James Loney was busted and charged with driving under the influence in Los Angeles, after he crashed his Maserati into two other cars on the freeway. James-Loney-los-angeles-DUI.jpg

The 27-year old apparently spat a breathalyzer mouthpiece at one of the police officers and demonstrated symptoms that any Los Angeles DUI lawyer would tell you could get you in serious trouble with the law. Per TMZ.com: “Loney’s behavior was incredibly bizarre…[he] exhibited eyelid tremors and his shirt was soiled and moist from perspiration, from his armpits down to his waistline.”

From the headlines, the case sounded cut and dry. But lo and behold, twists and turns have happened, as they often do, as any established Los Angeles DUI attorney will tell you.

The toxicology reports on Loney came back NEGATIVE. That means the prosecutors do not have evidence to pursue his case. The LA City’s Attorney’s Office has dropped the matter.

No drugs and no alcohol. Interesting.

Loney’s arrest obviously captured the city’s imagination. He plays for Dodgers. Also, it’s not every day that you see a Maserati spinning wildly out of control and crashing into vehicles on the freeway. Incidentally, Loney just inked a deal with the Dodgers for $6.4 million. Next year, he will be eligible to be a free agent.

But not every LA DUI arrest is as flashy. If you or someone you love was involved in a more pedestrian (meaning: “less dramatic” not “I was walking”) experience of Los Angeles DUI, you might wonder how this story could be relevant to your defense.

After all:

A) You’re not a first baseman for the Dodgers.

B) You do not (presumably) own a Maserati.

C) You know better than to spit a breathalyzer mouthpiece at a police officer (presumably).

This seems like a relatively simple question to answer. But it’s a question that can provoke a tremendous amount of anxiety. In his book The Paradox of Choice, Schwartz destroys one of the most common myths in our consumer-oriented society. Most of us believe that “the more choices, the merrier.” In other words, when we have more options, we will be more likely to find the “best fit” for our needs, whether we are shopping for shoes, a new house, or a Beverly Hills DUI lawyer. Instead of choosing from six choices, we would rather choose from 60. This kind of optimization thinking has been drilled into our subconscious since childhood.

But Schwartz points out that superabundance of choice leads to analysis paralysis and dissatisfaction with the final results. In other words, when you have to make a decision between 60 different options, even if you choose one that’s “better” than any option you might have gotten had you restricted your choices to six, you will feel worse about the outcome and ultimately less satisfied with your decision over the longer term.

This is the Paradox of Choice: the more choices you have, the less happy you will be with your final choice!

One reason is that when you are exposed to a lot of choices, you will constantly think about how your final choice compares to all the options you didn’t choose. On some level, we all intuitively recognize this problem. Think back to last time you went to Jerry’s Deli or another diner in Long Beach and got overwhelmed by the sheer size of the menu. No matter what you picked – the giant omelet, burger and fries, soup du jour, etc. – you “missed out” on hundreds of other meals you might have also wanted to try.

The solution, according to Schwartz, is to aim for “good enough” solutions to your problems. In other words, you don’t want to be careless and just eliminate choices for the sake of eliminating them. But you want to be choosy about how you choose. A “satisfactory” choice may ultimately leave you feeling better about your decisions than a “best” choice, ironically enough.

You might think that people who have been arrested for driving under the influence in Burbank or elsewhere in SoCal would be able to bond over their experiences. Especially if those two people were once friends and lovers. But that’s not always the case…lindsay-lohan-samantha-ronson-dui-spat.jpg

As this blog reported a few weeks ago, DJ and party girl Samantha Ronson got pulled over near Bakersfield and arrested for driving under the influence while en-route to LA from the city that never sleeps. According to Gather.com, Ronson allegedly called her ex-girlfriend, Lindsay Lohan – one of the most famous faces of all-time in the Los Angeles DUI blogosphere – expecting, possibly, consolation and commiseration.

Instead, allegedly, the “mean girl star turned mean for real and lambasted her former girlfriend, taunting her, calling her names, and laughing at her current misfortune. “Wow, you turned out to be a fine example…” LiLo sneered. “You think you would have learned something from all those hours of boring lectures you gave me!”

The Gather.com article said that the conversation between the exes was “loud” and “ended with Ronson yelling that she would never call her evil ex again and then slamming down the phone.”

Obviously, this story is a bit salacious. Ronson and Lohan were, at one time, tabloid staples. But the story illustrates a deeper truth about the Burbank DUI process. Specifically, surprises abound. You might expect one person in your life to be sympathetic, but be surprised to be met with scorn and opprobrium. Last Tuesday, a Los Angeles DUI story managed to (briefly) distract Angelinos from the imminent closure of the 405 (a.k.a. “Carmageddon”). Rodney King — the famous LAPD beating victim whose video beating, as you might remember, ignite race rights in the city and ultimately branded L.A. as a cauldron of intolerance for over a decade — got stopped by police who witnessed him committing multiple traffic violations. carmageddon.jpg

King was apparently pulled over and booked without incident. (not unlike most arrests for Los Angeles DUI, Burbank DUI, Glendale DUI, or Pasadena DUI). The 46-year old minor celebrity (he appeared on a recent season of Dr. Drew’s “Celebrity Rehab”) is no stranger to charges of driving under the influence in Los Angeles. In 2003, he collected a DUI. And just this March, police pulled him over one day short of the 20th anniversary of his famous taped beating for driving with an expired license.

It’s unclear yet whether King was indeed violating California Vehicle Code Sections 23152(a) or 23152(b). Either way, given King’s history with city law enforcement – and their history with him – even if the charges turn to be relatively mundane and King cooperates (i.e. there is no drama), you can be sure that you will be reading a lot about the aftermath of this arrest in the blogosphere. Perez Hilton, for one, published a snappy and snarky blog post about King’s arrest just hours after the news broke.
